This website is a reservation funnel. It allows you to pay a small reservation deposit that secures your access to preferential pricing for our crowdfunding campaign. It is not a general online store, and placing a reservation deposit is not a purchase of the product.
Our product is offered to the public through a crowdfunding campaign hosted on a third-party platform (Kickstarter). When you back that campaign, your pledge and payment are handled by that platform and are governed by the platform's own terms of use and privacy policy, in addition to these Terms and our Returns Policy. We encourage you to read the platform's terms before backing.
Crowdfunding involves risk. Backing a campaign supports the development and production of a product and does not guarantee that the product will be produced or that you will receive it, and delivery timelines are estimates that may change. You may adjust or withdraw your pledge before the campaign closes in accordance with the platform's terms.
The fee you pay on this website is a reservation deposit that secures your access to preferential campaign pricing. It does not guarantee production or delivery of the product, and it does not itself entitle you to a product.
Except where a mandatory consumer right in your country of residence requires otherwise (see Section 18), the reservation deposit is non-refundable. Where the law of your country gives you a right to a refund or a cooling-off / withdrawal period that cannot be excluded, that right applies in full and takes precedence over the preceding sentence.
By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have given us your consent to allow any minor dependents to use this site.
You may not use our Service or products for any unlawful or unauthorised purpose, and you may not, in your use of the Service, violate any laws in your jurisdiction (including copyright laws). We reserve the right to refuse or cancel any reservation you place with us. We may, in our sole discretion, limit or cancel quantities reserved per person, household, payment method, or billing/shipping address, and we reserve the right to limit or prohibit reservations that appear to be placed by dealers, resellers, or distributors. If we cancel a reservation, we may attempt to notify you using the email, billing address, or phone number you provided, and we will refund any deposit paid for a reservation we cancel, unless the cancellation results from your breach of these Terms.
You agree to provide current, complete, and accurate reservation and account information, and to promptly update it (including your email address) so that we can complete your transaction and contact you as needed.
Our product contains a lithium-ion battery. You agree to use it only in accordance with the instructions and safety information provided with the product. In particular, you agree not to use a product that is damaged, swollen, overheating, or otherwise faulty; not to open, modify, puncture, or attempt to repair the battery; and to keep the product away from extreme heat, water, and fire.
If your product appears faulty or unsafe, stop using it and contact us at enquiries@pulsoniq.com. Nothing in this section limits any right you have in respect of a product that is faulty, unsafe, or not as described.
We may provide access to third-party tools that we neither monitor nor control. You acknowledge that we provide access to such tools "as is" and "as available" without warranties of any kind, and that your use of them is at your own risk. You should review the third party's terms before using such tools. Any new features or tools added in future are also subject to these Terms.
Certain content, products, and services available through our Service may include materials from, or links to, third parties whose websites are not affiliated with us. We are not responsible for examining or evaluating their content and do not warrant, and are not liable for, any third-party materials, websites, products, or services. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in those jurisdictions our liability is limited to the maximum extent permitted by law.
Nothing in these Terms — including Sections 2, 16, and 17 — excludes, restricts, or modifies any consumer guarantee, warranty, remedy, or other right you have under the mandatory laws of your country of residence that cannot lawfully be excluded.

You agree to indemnify, defend, and hold harmless Pulsoniq and its affiliates, officers, directors, agents, contractors, licensors, service providers, suppliers, and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party. Nothing in this section requires you to indemnify us for losses caused by our own negligence or breach, to the extent applicable law prohibits it.
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed. Such a determination does not affect the validity and enforceability of the remaining provisions.
The obligations and liabilities of the parties incurred before the termination date survive termination for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate them at any time by ceasing to use our site and notifying us that you no longer wish to use our Services. If we consider, in our reasonable judgment, that you have failed to comply with any provision of these Terms, we may terminate this agreement at any time; you will remain liable for all amounts due up to the date of termination, and we may deny you access to our Services.
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
